1. |
Purpose of the Service Training Site |
|
Brother provides information regarding the maintenance and technical service "Information" of Brother branded products ("Products") at its web site ("Service Training Site") for the purpose of giving online training to the service engineers of the Service Center. The purpose of this Information is the improvement of the expertise of service engineers in the maintenance of the Products and enhancing the technical support for customers using the Products ("Customers"). No other purpose is intended or implied. |

2. |
Intellectual Property Rights |
|
Brother or third parties who have licensed Brother shall reserve all intellectual property rights (the rights which could be protected by the copyright law, the design law, the trademark law and other intangible property laws) concerning any documents, programs, movies, animations, articles, sketches, drawings, software, databases and other materials available on the Service Training Site (the "Intellectual Property Rights"). Other than to utilize the knowledge and skills acquired through the Service Training Site for technical support to the Customers, the Service Center is prohibited from reproducing, distributing, modifying, displaying, showing, publicly transmitting or otherwise creating derivative works of any of Intellectual Property Rights, in whole or in part, regardless of form or medium, without prior permission from the intellectual property right owner(s). |

Trademarks |
|
All trademarks, service marks and logos used in the Service Training Site are the trademarks, service marks or logos of their respective owners as identified on the Service Training Site. Brother gives no permission for any trademark, service mark, logo or anything that could be construed as a trademark produced on the Service Training Site to be used in any way without the express permission of the respective owners. This may include but is not limited to certain words, phrases or any other entities covered by trademark laws. |

Confidentiality |
|
All the Information is confidential excluding information which:
(1) |
is already in or comes into the public domain otherwise than by disclosure or default by the Service Center; |
(2) |
was or is lawfully obtained or available from a third party who was lawfully in possession of the same and free to disclose it; or |
(3) |
was already known to the Service Center as evidenced by written record pre-dating such disclosure. |
Other than to utilize the knowledge and skills acquired through the Service Training Site for technical support to Customers, the Service Center shall not disclose, publish, or disseminate Information to any person other than its officers, directors or employees with a specific need to know. |

5. |
Warranty |
|
While Brother uses its best efforts to include accurate and up-to-date information on the Service Training Site, Brother makes no expressed or implied warranties as to its accuracy or completeness. Brother does not warrant the result to be obtained from the use of the Information. |

6. |
Limitation of Liability |
|
Liability of Brother in respect of any defect in the Information shall be limited to the replacement of the defective Information. To the extent permitted by law, Brother shall not be liable to the Service Center or any other party for any costs, claims, loss or damage of whatever nature and howsoever caused, including but not limited to special, incidental or consequential damages resulting from any breach of warranty or condition, or under any other legal theory. |
